Maharashtra landlords and tenants have always been involved in the horns of a dilemma when it comes to the Leave and License Agreement. The L&L contract is required to be registered in accordance with section 55(1) of the Maharashtra Rent Control Act 1999. § 55, paragraph 2, clearly imposes this responsibility on the owner. § 55 also provides that, in the absence of a registered written agreement, priority is given to the tenant`s dispute over the conditions under which the premises have been either put on leave and licensed, or even rented. Under Article 55(1), it is clear that only the rental agreement or leave and licence concluded between the lessor and the lessee or licensee is subject to registration. The basic framework of stamp duty is set out in the Indian Stamp Act of 1899, which allows states to modify them according to their needs.
